    These days a good lawyer doesn’t just litigate but has other tools in his or her arsenal to assist clients to resolve disputes.  Negotiation, whether informal or during the course of litigation, is responsible for the resolution of most commercial disputes.

    Our lawyers are experienced negotiators.  Whether presenting your position directly, working behind the scenes, or in a formal mediation, we will assist you to present your case logically, commercially and persuasively.

    We understand that negotiation and mediation can be nerve-wracking for some clients.  The other side’s lawyers may try to use the opportunity to browbeat you into settling your case for less or more than is commercial.

    Being prepared is the key to maximising your chances of a good outcome.  Our lawyers will assist you to:

  • understand the strengths and weaknesses of your position;
  • anticipate the points that your opponent will make and have ready the best answers to them;
  • know what it has cost you so far and decide what you are prepared to accept or pay; and
  • maintain your considered position on the day.

    Most mediations today are facilitated by an independent mediator, whose role is to coax the parties to settle.  Mediators often have different styles and some take a more active role than others.  Choosing the right mediator for the job and knowing what to expect before the day is important in preparing your mediation strategy.

    Our philosophy is to explore the most cost-effective methods of resolving our clients’ disputes.  Talk to us about how we can assist you.
