Jane Vincent is an Associate with Maurice Blackburn Commercial specialising
in commercial litigation
and dispute resolution. She has wide
ranging experience in the conduct of commercial proceedings including
undertaking large-scale commercial litigation, insolvency litigation,
franchising and licensing disputes and advisingon general contractual
disputes.
Examples of her recent experience include:
Together with Steve Foale, successfully resolved
proceedings commenced by the liquidators of Centaur Mining & Exploration Ltd
against the company's directors for breach of the insolvent trading provisions
of the Corporations Act
Acting for the appointed liquidator of a manufacturing company in conducting voidable transactions proceedings such as unfair and uncommercial preference claims;
Acting for the appointed liquidator of a seafood processing and distribution company in conducting unfair preference claims and investigating potential insolvent trading proceedings;
Acting for a high net worth individual and his superannuation fund in proceedings commenced in the Supreme Court of Victoria against the superannuation fund's former superannuation advisers alleging professional negligence in relation to the provision of superannuation advice;
Acting for a business and an individual in defending proceedings commenced in the Melbourne Magistrates' Court alleging breach of sale of business contract and misleading and deceptive conduct; and
Assisting in a large representative proceeding commenced in the Supreme Court of NSW acting for superannuants against the trustee and former directors of the superannuation fund alleging, inter alia, misrepresentation and mismanagement.
